1. Agreement to Terms

By submitting the contact form on our website, you acknowledge that you have read, understood, and agree to be bound by these terms, our Privacy Policy, and our Legal Indemnity agreement. Submission of the form constitutes your legal consent.

2. Accuracy of Information

You certify that all information provided in the contact form is true, accurate, complete, and current. You are responsible for any inaccuracies or omissions. False or misleading information may result in service denial or legal action.

3. Data Collection & Usage

By submitting the form, you authorize 8 Finger HVAC LLC to:

• Collect, store, and retain all submitted information indefinitely
• Use your information to contact you regarding service requests, pricing, and follow-ups
• Share your contact information with technicians, financing partners, and authorized third parties
• Add your information to our marketing database and contact lists
• Use your service address and history for service area planning and analysis

4. SMS & Marketing Communications

By submitting this form, you explicitly consent to receive SMS text messages and promotional emails from 8 Finger HVAC LLC. This consent is required if you have selected financing options or expressed interest in financing. Standard message and data rates apply. You acknowledge that this is not a condition of purchasing our services, except where financing is involved.

5. Financing Eligibility

If you have selected interest in financing options, you agree to:

• Receive SMS and marketing communications from 8 Finger HVAC LLC and financing partners
• Allow us to conduct credit inquiries and share your information with lenders
• Accept that financing approval is solely at the lender's discretion
• Pay any costs associated with financing, including interest and fees

6. Service Request Acknowledgment

By submitting a service request, you acknowledge:

• You own or have legal authority to authorize access to the property
• The property is safe and accessible for service technicians
• You understand HVAC service may require electrical access, gas line work, or structural modifications
• You assume all risks associated with service work
• You agree to pay for all services rendered upon completion

7. Property Access & Safety

You certify that the property is safe for service work and free from hazards, pests, or dangerous conditions. You are liable for any injuries or damages to our technicians or equipment caused by undisclosed hazards or unsafe conditions at your property.

8. No Obligation for Service

Submission of a service request does not guarantee service availability, scheduling, or acceptance by 8 Finger HVAC LLC. We reserve the right to decline service requests at our sole discretion.

9. Service Call Fees

You acknowledge that service calls may result in charges for travel time, diagnostics, labor, and materials. Pricing will be provided before work begins unless an emergency situation exists. Emergency services may be subject to additional fees.

10. Modification of Terms

8 Finger HVAC LLC reserves the right to modify these terms at any time. Continued use of the contact form following changes constitutes acceptance of the modified terms.

11. Entire Agreement

This agreement, combined with our Privacy Policy and Legal Indemnity statement, constitutes the entire agreement between you and 8 Finger HVAC LLC regarding your use of the contact form and our services. No other agreements, representations, or warranties apply unless expressly stated in writing and signed by both parties.

12. Acknowledgment

By clicking "Submit" on the contact form, you affirmatively acknowledge that you have read and agree to all terms contained in this agreement, our Privacy Policy, and our Legal Indemnity statement. This submission serves as your electronic signature and binding consent.

13. Second Opinion Submissions & Fraudulent Information

Fraudulent Submissions Prohibited: You certify that all documents, estimates, quotes, and information submitted through our Second Opinion service are authentic, unaltered, and accurately represent quotes or estimates you have received from other HVAC contractors. Submitting falsified, fabricated, or misleading documents — including but not limited to forged estimates, altered pricing, or documents created by you or an associate rather than a legitimate contractor — constitutes fraud under Iowa Code § 715A.2 and may be subject to civil and criminal penalties.

Defense to the Full Extent of the Law: 8 Finger HVAC LLC reserves the right to pursue all available legal remedies against any individual or entity that submits fraudulent, falsified, or misleading information through this service. This includes, without limitation, the right to pursue civil damages, report fraudulent activity to law enforcement, and cooperate with any criminal investigation. Any legal action arising from fraudulent submissions shall be governed by and construed in accordance with the laws of the State of Iowa, and the parties consent to the exclusive jurisdiction and venue of the United States District Court for the Southern District of Iowa (or, where applicable, the state courts located within the Southern District of Iowa) for resolution of such disputes.

By submitting documents through our Second Opinion service, you acknowledge that you have read, understood, and agree to these terms, and that any fraudulent submission is defensible by law to the fullest extent permitted by applicable state and federal law.
